The government’s new Financial Regulatory legislation will provide new powers to plan sponsors who have long sought a larger voice on issues of corporate governance. These expanded rights will be defined as regulators establish the rules to support the legislation. This has occurred after years during which plan sponsors have become increasingly engaged on issues related to corporate governance and their own fiduciary responsibilities in enforcing their rights on behalf of their participants. How will the new regulatory scheme help plan sponsors? How can they influence regulators to produce rules that will accommodate their needs? With a yawning funding gap, pension plans increasingly are being pressured to exit the retirement saving business. All roads appear to lead to a migration from DBs to DCs or do they? The world has quickly come to accept that economic growth, and the power and influence that comes with it, is shifting toward emerging and developing nations, China foremost among them.
